بيان قانوني صادر باسم الآلية السورية للتحقيق حول ما يسمى “بيت الأخوات”
تابعت الآلية السورية للتحقيق بقلق بالغ ما يتم تداوله حول تكرار حوادث الاختفاء والخطف التي تستهدف فتيات من ابناء الطائفة العلوية والتي تنتهي في عدد من الحالات باعلان اسلام الفتاة وانقطاعها الكامل عن عائلتها وذلك في ظروف تثير تساؤلات قانونية وحقوقية خطيرة
وفي القضية الاخيرة المتعلقة بالشابة بتول سليمان علوش، برز اسم مكان يعرف باسم “بيت الاخوات” قيل انه مخصص لاستقبال فتيات من خلفيات دينية غير مسلمة مع معلومات متداولة لم يتم التحقق منها بشكل نهائي تربطه بمؤسسة “الذهبي” ذات النشاط الدعوي الاسلامي
ان ما يثير القلق بصورة خاصة هو الحديث عن وجود حراسات على المكان وتنظيم مؤسسي واضح وامكانية الوصول اليه او التنسيق معه من قبل جهات حكومية وامنية الامر الذي يفرض طرح اسئلة قانونية مباشرة حول طبيعة هذا المكان ووضعه القانوني والجهات المشرفة عليه
وعليه تطالب الآلية السورية للتحقيق كلا من وزارة الشؤون الاجتماعية والعمل ووزارة الداخلية باصدار توضيح رسمي وعاجل يتضمن بيان الطبيعة القانونية لما يسمى “بيت الاخوات”, وتوضيح ما اذا كان المكان حاصلا على تراخيص رسمية وتحت اي صفة قانونية واالكشف عن الجهة الادارية او الدينية او المدنية التي يتبع لها, وتوضيح الاساس القانوني لوجود حراسات او قيود على الوصول الى الموجودات داخله, و بيان ما اذا كان يخضع لاشراف قضائي او رقابة من الجهات المختصة, وتبيان حقيقة العلاقة بين هذا المكان واي مؤسسات دعوية او امنية او حكومية.
كما تؤكد الآلية السورية للتحقيق ان اي جهة تقوم بايواء نساء او فتيات في ظروف تتعلق بالتحول الديني او الانقطاع عن الاهل دون ضمانات قانونية واضحة وشفافة ودون امكانية التواصل الحر مع العائلة او الوصول القانوني المستقل تضع نفسها تحت طائلة المساءلة القانونية والحقوقية.
وتشدد الآلية على ضرورة فتح تحقيق مستقل وشفاف في طبيعة عمل هذا المكان وضمان حماية الحقوق الاساسية لاي فتاة موجودة داخله وفي مقدمتها حرية الارادة وحرية التواصل والحماية من اي شكل من اشكال الاحتجاز او الاكراه غير القانوني.
The Syrian Investigation Mechanism expresses its deep concern over the repeated reports of disappearances and abductions targeting young women from the Alawite community, which in several cases have reportedly ended with the young women announcing their conversion to Islam and completely cutting ties with their families, under circumstances that raise serious legal and human rights concerns requiring transparency and independent investigation.
In the most recent case concerning the young woman, Batoul Suleiman Alloush, the name of a place known as the “Sisters’ House” emerged. It has been described as a facility designated to receive girls and women from non-Muslim religious backgrounds, alongside circulating information — not yet independently verified — linking it to the “Al-Dhahabi” institution, known for its Islamic missionary activities.
What raises particular concern is the reported existence of security guards at the facility, an apparent institutional structure, and allegations regarding the ability of governmental and security actors to access or coordinate with the location. This necessitates direct legal questions regarding the nature of this facility, its legal status, the entities supervising it, and whether its activities comply with Syrian law and international human rights obligations.
Accordingly, the Syrian Investigation Mechanism calls on both the Ministry of Social Affairs and Labour and the Ministry of Interior to issue an urgent and official clarification addressing the following:
The legal nature of the so-called “Sisters’ House.”
Whether the facility is officially licensed, and under what legal designation it operates.
The identity of the administrative, religious, or civil entity overseeing it.
The legal basis for the presence of guards or restrictions on access to the women residing inside.
Whether the facility is subject to judicial oversight or monitoring by competent authorities.
The true nature of any relationship between this facility and any religious, security, or governmental institutions.
The Syrian Investigation Mechanism further stresses that any entity housing women or girls in circumstances related to religious conversion or separation from their families, without clear and transparent legal safeguards, and without guaranteeing free communication with their families or access to independent legal representation, places itself under potential legal and human rights accountability.
The Mechanism also calls for an independent and transparent investigation into the nature and operations of this facility, and for the protection of the fundamental rights of any girl or woman residing there, foremost among them freedom of will, freedom of communication, and protection from any form of unlawful detention or coercion.
Furthermore, the Mechanism calls on independent judicial and human rights bodies, as well as local and international human rights organizations, to seriously monitor this case and ensure that no institutions or closed facilities are used to impose religious or social choices on women under any pretext or cover.
